Terms of Service for Placesurf
Article 1 (Purpose)
These terms set forth the conditions and procedures for using the service provided by Kitform (the “Company”) through Placesurf (the “Service”).
Article 2 (Definitions)
The definitions of terms used in these terms are as follows:
- ① “Company” refers to Kitform, the provider of the Service.
- ② “User” refers to both members and non-members who use the Service provided by the Company in accordance with these terms.
- ③ “Member” refers to a person who has registered by providing personal information and can continuously use the Service and receive information from the Company.
- ④ “Log” refers to posts that include photos taken by users and descriptions of the places they visited.
- ⑤ “Content” refers to all posts, photos, images, videos, and any other data or information posted by users on the Service.
Article 3 (Effect and Changes to the Terms)
- ① These terms apply to all users who wish to use the Service.
- ② The Company may change these terms for reasonable reasons, and the changed terms take effect from the date of posting via the notice section in the Service.
- ③ If a user does not agree to the changed terms, they may stop using the Service and withdraw. Continued use after the effective date is considered agreement to the changes.
Article 4 (Use of Service)
- ① In principle, the Service is available without age restriction, but it will soon be limited to users aged 14 or older, with prior notice.
- ② The Service is available 24/7 in principle, but may be temporarily suspended due to business or technical reasons.
- ③ The Company may conduct regular inspections, and the time will be announced on the service screen.
Article 5 (Sign Up)
- ① Sign-up is only available via social login (Google, Facebook, etc.).
- ② Users must provide the following personal information upon registration:
- Email address from the SNS account
- Nickname from the SNS account
- Profile photo from the SNS account
- Year of birth
- ③ There is no distinction between membership levels.
Article 6 (Privacy Protection)
- ① The Company values user privacy and complies with the Act on Promotion of Information and Communications Network Utilization and Information Protection, the Personal Information Protection Act, and other relevant laws.
- ② Details regarding the collection, use, third-party provision, outsourcing, and disposal of personal information are governed by the Privacy Policy, which can be accessed within the service.
- ③ The Personal Information Protection Officer is Dahye Jang, and the contact number is 010-5092-9069.
- ④ The Company temporarily collects user location information for search features and deletes it immediately afterward.
- ⑤ The Privacy Policy contains detailed terms regarding personal information and is separate from these Terms.
Article 7 (Posting and Management of Content)
- ① Users may post logs including photos and descriptions of places they have visited through the service.
- ② The company may delete content without prior notice in the following cases:
- Posts containing explicit content
- Posts causing discomfort to others
- Posts that violate laws or go against social norms
- ③ Users may edit the title and description of posts, but not the photos or images.
Article 8 (Intellectual Property Rights)
- ① Intellectual property rights (including copyrights) to posts and content created by users are jointly owned by the user and the Company.
- ② Both the user and the Company may use jointly owned intellectual property without restriction, and neither party is obliged to share profits.
- ③ The Company may use user content for marketing purposes, and the user agrees to this.
- ④ All copyrights and intellectual property rights of the Service belong to the Company.
Article 9 (Restrictions on Service Use)
- ① If a user engages in any of the following actions, the company may restrict service use or terminate the service agreement without prior notice:
- Acts that damage or disadvantage the reputation of others
- Infringement of intellectual property rights of others
- Distribution of content that violates public order or morals, such as information, text, or images
- Other illegal or inappropriate acts
Article 10 (Service Relationship Functions)
- ① Users can follow other users through the follow feature.
- ② Comments and messaging features are planned for future development and are not currently available.
- ③ Notification services are provided in the following cases:
- When a new follower is created
- When a followed user posts new content
- When another user bookmarks your post
Article 11 (Reporting and Handling of Posts)
- ① Users can report inappropriate posts using the inquiry function.
- ② The Company will review reported posts and delete them if necessary.
- ③ Posts deemed sexually explicit or offensive may be deleted after internal review.
Article 12 (Membership Withdrawal)
- ① Users may request to withdraw their membership at any time, and the Company will immediately process such requests.
- ② Upon withdrawal, all personal data of the user will be immediately deleted from the database.
- ③ However, data may be retained if required by relevant laws.
Article 13 (Inactive Account Management)
- ① A user who has not used the service for over one year will be classified as inactive.
- ② Inactive users will be notified in advance, and their personal data will be separately stored.
- ③ To use the service again, inactive users must go through an identity verification process.
- ④ Separated data will not be used without separate consent and will be destroyed immediately after the legal retention period.
Article 14 (Termination of Service Agreement)
- ① The Company may terminate the agreement without notice if the user violates these terms.
- ② Upon termination, access to the service is immediately revoked, and all data is deleted.
Article 15 (Disclaimer)
- ① The Company shall not be liable for service interruption due to force majeure such as natural disasters, war, terrorism, or system failures.
- ② The Company is not responsible for issues caused by the user's fault.
- ③ The Company is not obligated to intervene in disputes between users or between a user and a third party, and assumes no responsibility for any resulting damage.
- ④ The Company does not guarantee the truthfulness or reliability of user-generated content and is not responsible for consequences resulting from it.
Article 16 (Damages)
- ① The Company is only liable for damages caused to the user due to intentional or gross negligence.
- ② The Company is not responsible for damages resulting from interruptions or changes to free services.
Article 17 (Governing Law and Jurisdiction)
- ① Legal disputes between the Company and users shall be governed by the laws of the Republic of Korea.
- ② Lawsuits regarding disputes between the Company and users shall be filed with the court having jurisdiction under the Civil Procedure Act. However, if the user's address is unclear or resides overseas, the Seoul Central District Court shall have jurisdiction.
Article 18 (Service Inquiries)
For inquiries regarding the use of the service, please use the inquiry feature within the service.
